Tender open for transgender inclusion guidance review

The tender will close on 16 November.

In August, Sport England, Sport Wales, sportscotland, Sport Northern Ireland and UK Sport confirmed that the Transgender Inclusion in Domestic Sport Guidance will be reviewed. 

This is to ensure that the guidance aligns with the updated context that sports are operating within.  

The contractual requirements for the review of the Transgender Inclusion in Domestic Sport Guidance have now been published and are available to view here.

The invitation to tender will close on 16 November. 

After procurement is completed, the review of the guidance is expected to begin in early 2027.

The revised guidance is estimated to be published later in the year.

  • Why is the guidance going to be reviewed?

    In April 2025, the Supreme Court Ruling (For Women Scotland Ltd vs. The Scottish Ministers) ruled that, under the 2010 Equality Act, the protected characteristic of ‘sex’ means a person’s biological sex.

    The updated Equalities and Human Rights Commission Statutory Code of Practice for services, public functions and associations became legally binding on 5 August 2026 and provides guidance as to how the Equality Act 2010 should be applied. The updated legal context means that a review of TIDS is necessary.  

    Additionally, a commitment to review TIDS in light of new scientific or medical evidence was made when it was published in 2021. 

    In April 2026, the sports councils commissioned an independent and impartial review of peer-reviewed scientific and medical evidence - spanning physiological and psychosocial literature - related to transgender inclusion in sport since the publication of the TIDS guidance.

    It also concluded that a full review of evidence would provide a more nuanced narrative around key issues emerging which may enable sports councils and national governing bodies to revise policies accordingly.  

    Please note that this Code of Practice does not apply in Northern Ireland. The Northern Ireland Equality Commission is asking the High Court to clarify how the Supreme Court’s judgment should be applied in Northern Ireland, given its different equality law framework, and the implications of Article 2 of the Windsor Framework for how that equality law should be interpreted.

  • Who 'owns' the guidance?

    The guidance is jointly owned by the four home country sports councils (Sport England, Sport Wales, Sport Scotland and Sport NI) and UK Sport. 

  • When will the new guidance be published?

    We are expecting publication in 2027.

  • Is the 2021 guidance still relevant?

    The external context we are operating in has changed.

    As a result, the 2021 guidance has been withdrawn and new guidance will be published to replace this.

    We will continue to support governing bodies through any questions or queries they have.
